Ground rent, kept separate

A figure in the lease is only the start of the check.

Identify the rent reserved by the signed lease, the current landlord, the review pattern and the correct demand route. Keep ground rent separate from service charges and administration charges.

The signed lease and later deeds

Record the rent, review dates, formula, payment dates, payer, payee and any replacement or varied lease. Do not infer the current parties from the original names alone.

The demanding party

Identify the current immediate landlord and any agent's authority. Keep the freehold, superior lease and current leasehold interest distinct.

The prescribed notice

Section 166 requires a notice before ground rent under a long lease of a dwelling becomes payable. Check the current prescribed form for England or Wales and the date stated in the notice.

The current-law status

For most regulated residential long leases granted from 30 June 2022, or 1 April 2023 for retirement-home leases, the permitted ground rent is generally a peppercorn. Exceptions and replacement leases need separate checking.

Notice and timing

Do not create or validate a demand from memory.

Section 166 sets statutory conditions for the notice and payment date. England and Wales use different prescribed forms. Open the current legislation and form, then compare it with the actual demand and service evidence. This page does not calculate a deadline or decide liability.
