Service charge demand paperwork

A missing rights summary is a fixable defect.

The prescribed summary

A residential service-charge demand must be accompanied by the prescribed summary of rights and obligations. The current England wording is set by the 2007 Regulations.

The landlord details

Section 47 requires the landlord's name and address on a written demand. A managing agent's details do not automatically answer that question.

The address for notices

Section 48 requires an address in England and Wales where notices may be served on the landlord. It can be supplied separately from the demand.

The age of the cost

Section 20B may restrict recovery of costs incurred more than 18 months before the demand, unless the required written notification was given within that period.

    Keep the full demand

    Save the document, attachments, envelope or email and any earlier notices. A ledger entry or reminder may not show the complete pack.

    Record what is missing

    Name the absent document or information. Do not turn five paperwork checks into a legal collectability score.

    Ask a neutral question

    Request the missing material, the lease clause relied on and the supporting breakdown without asserting permanent invalidity.

    Pause before withholding

    The statutory consequences differ and defects may be corrected. Get case-specific advice before taking a payment or enforcement position.
