Lease clause and payment conditions

Include any requirement for a budget, certificate, accounts or notice before payment.

Prescribed summary of service-charge rights

Use the correct prescribed summary for England or Wales.

Landlord name and address

Check the landlord information, not only the agent. An overseas landlord address needs an additional address in England or Wales for notices.

Address for serving notices

The section 48 address may have been supplied separately.

Period, amount and cost breakdown

Record which period and type of service charge the demand covers.

Lease share and calculation

Check the cost schedule and the percentage, fraction or other method.

Cost dates and any section 20B notification

A cost older than 18 months needs a separate timing check; an earlier qualifying notification may matter.

Consultation papers where relevant

Major works and long-term agreements can require a separate consultation check.

Find the lease terms about payment requests, due dates and any budget, account, certificate or notice required before payment. Identify the payment types these terms apply to. Explain what the lease can establish and which checks need the actual demand, other records or current law. Do not assume a demand is invalid because I have not found a document.

Quote the short wording you rely on and give the clause or schedule and page for each point. Say clearly if something is ambiguous or not found. Separate the lease wording from current-law questions and facts needing other evidence. Do not guess or decide whether I should pay, withhold payment or take legal action.
